Issue Brief

Assembly Bill 126, supported by ARDA and ARDA-ROC, would reestablish limits on access to timeshare association owner lists, which were set aside in a recent state court ruling. The ruling made it possible for a single owner to request a copy of the list for their association with minimal restrictions, putting the personal information of the remaining owners at risk.

Impact

If passed, AB 126 would prevent owner list information from being released to individual owners while preserving the ability of an owner to communicate regarding legitimate association business. Once acquired, under the current circumstances, owner contact information can easily be used for unwanted solicitation and fraudulent activity.

ARDA and ARDA-ROC support Assembly Bill 126.

Issue Updates

AB 126 is stalled in the Assembly Judiciary Committee at the present time, due to opposition from the chair.

Resolution

Assembly Bill 126 failed to meet the deadline for passage in its chamber of origin due to opposition in the Judiciary Committee.  The bill will not move forward in 2014.
