CA Owner Privacy Bill Blocked for 2014

Assembly Bill 126, supported by ARDA and ARDA-ROC, failed to meet a deadline for passage from the Assembly to the Senate due to opposition in the Judiciary Committee. As a result, the bill will not pass this session.  It would have reestablished limits on access to timeshare association owner lists, which were set aside in a recent state court ruling. The ruling made it possible for a single owner to request a copy of the list for their association with minimal restrictions, putting the personal information of the remaining owners at risk.

Impact

AB 126 would have prevented owner list information from being released to individual owners while preserving the ability of an owner to communicate regarding legitimate association business. Once acquired, under the current circumstances, owner contact information can easily be used for unwanted solicitation and fraudulent activity.

Resolution

Assembly Bill 126 failed to gain passage in the Assembly due to opposition in the Judiciary Committee. As a result, the bill will not move forward this session.
